Notice of Adoption | OPA 41: Municipal Wide Natural Heritage System

Notice of Adoption | OPA 41

In accordance with Section 17(23) of the Planning Act, take Notice that Council of the Corporation of the Town of Mono passed Bylaw No. 2018-23 on the 24th day of July 2018 approving Official Plan Amendment No. 41 (Municipal Wide Natural Heritage System).

The purpose and effect of this Amendment to the Official Plan is to identify and preserve natural heritage features in conjunction with applications for proposed developments and/or site alterations under Part 3 of the Planning Act.  The policies in OPA 41 will broadly protect and enhance the natural heritage features and functions within the Town and also provide the local basis in support of the future County-wide Natural Heritage System that is to be undertaken with Dufferin County’s Official Plan Municipal Comprehensive Review.

This Amendment also fulfills the policy objectives of Section 2.1 of the 2014 Provincial Policy Statement, Section 4.2.2 of the Provincial Growth Plan and supports related goals in the associated Provincial Plans for the Greenbelt, Niagara Escarpment and Oak Ridges Moraine.

No key map is provided as OPA 41 is a Municipal wide amendment.

Council of the Town of Mono is the approval authority for Official Plan Amendment No. 41 and the decision of Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.  The last day that this decision may be appealed to the Local Planning Appeal Tribunal (LPAT) is the 15th day of August 2018.  A notice of appeal on the prescribed form must be filed with the Clerk of the Town setting out the reasons for the appeal and specific part of the proposed official plan to which the appeal applies, accompanied by the fee of $300.00 by certified cheque or money order payable to the Minister of Finance.  If you wish to appeal to the LPAT, the appeal form is available from the LPAT website at http://elto.gov.on.ca/tribunals/lpat/forms/ or available at the Town of Mono municipal office.

Only individuals, corporations and public bodies may appeal a decision of the Town to the Local Planning Appeal Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the Bylaw was adopted, the person or public body made oral submissions at a public meeting or written submissions to Town council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
